Just a wandering soul with no true home.

Hailing from the underground city of nāgas, Soma is a seven headed nāgini born into a family of healers. As part of her coming of age, she was sent on a pilgrimage to experience the mortal world and find out why humans no longer sought out her kind.She observed mankind's grand inventions and listened to stories of their strange deeds during her travels. Most importantly, she learned that advancements in human medicine left much fewer illnesses untreatable. It fascinated her, but also made her healing abilities feel frivolous.Soma chose to find a new purpose for herself in human society, but she needed to know more about it's culture first.

T E R M S - OF - S E R V I C EBy commissioning the artist ‘phasmonyc’, the client agrees that they have read and accepted the Terms of Service (ToS) outlined below.There are different terms in the Client's Rights & Permissions section depending on whether it is personal-use or commercial-use. Please read this carefully and do not hesitate to contact me if you have any questions.

P A Y M E N T- Payment is only accepted via PayPal, an invoice will be sent to the commissioner after discussing the commission piece and price.
- Commissions must be paid either:
• In full amount, as stated in the PayPal invoice, prior to starting work on the commission.
• In two parts where 50% is paid prior to starting; and the other 50% on completion of the commission.- Additional services bought after starting on the commission will be sent in a separate invoice and must be paid in full before it is considered “added on”.- It is preferred for commissions to be paid in US Dollars ($USD).

W O R K F L O W - & - C O M M U N I C A T I O NPreferred method of communication is via E-mail [email protected] or Discord.- It is encouraged for the client to send as many reference images as possible.- The artist will send up to three thumbnail sketches to the client.- The client may choose a sketch to be completed, ask to modify a sketch, or ask to combine parts into a new sketch.- The client must pay either 50% or the full amount payable before progress continues.- The artist will send updates at least once every fortnight, and at each stage (i.e. line art and colors) for client approval.- The completed commission will be sent via the client's preferred file transfer method.

R E V I S I O N S- After the approved sketch stage, a maximum of three revisions is allowed before incurring additional fees.- Revisions for a stage is not allowed after that stage has been approved.- Revisions due to artist’s error are free, provided the commissioner points out the error immediately and it is within the scope of what has already been paid for.- Revisions beyond the scope of what has been paid for are considered additional services bought.

C A N C E L L A T I O N S - & - R E F U N D SArtist’s Decision to Cancel
- The artist reserves the right to refuse a commission for any reason and under any circumstances. Reasons include, but aren’t limited to:
• Commission contains subject matter the artist does not want to draw e.g. mecha.
• Unfavorable time constraints i.e. a short deadline the artist cannot meet.
• Busy personal/work life.- The artist retains the right to cancel a commission at any point after being paid for any reason. The client can choose to either be partially or fully refunded.
• If a partial refund is given, it will be according to how much work has been completed and high resolution files of the partially completed artwork will be sent to the client.
• If a full refund is given, the client will not receive any artwork.Client’s Decision to Cancel
- The client cannot cancel or ask for a refund after the commission is completed.- The client retains the right to cancel at any time before the commission is completed, for any reason.
• If the client cancels before work on the commission has begun, the client will be refunded in full.
• If work has already begun, a partial refund will be given according to how much work has been completed and high resolution files of the partially completed artwork will be sent to the client.- Cancellations due to dissatisfaction with work that the client has already approved will not be refunded.

P E R M I S S I O N S - & - U S A G EArtist’s Rights- The artist retains the right to post commissioned work publicly online and use it in their portfolios.
(Please note that commissions containing personal subject matter to the client will not be posted publicly out of courtesy.)- The client may request that the finished piece not be posted publicly, subject to a privacy fee. The client has a responsibility to alert the artist about this before work starts on the commission.- The artist retains the right to work on canceled commissions for use as prints or other merchandise. These versions will not contain characters belonging to the client.Client’s Rights and Permissions- The client may not under any circumstances claim the commission as their own art or mint it as a Non-Fungible Token (NFT).- The client may not have a third party or themselves draw over, finish, rework, or otherwise alter the image (i.e. commissioning line art and having a third party render the artwork) without express written permission.PERSONAL-USE
- The client retains the right to post the commission online.- The client may use, crop or otherwise alter the commission for personal use as an icon, profile picture, banner, wallpaper, etc.- The client may not use the commission for commercial purposes without paying a commercial-use license fee.COMMERCIAL-USE
- The client retains the right to use the art for any personal or commercial purposes.
Commercial purposes include, but are not limited to:
• Promotional use of artwork i.e. as book covers; part of a business’s promotional material; as icons, banners, or emotes in social media accounts or servers with intent to generate revenue.
• Making profit via physical product sales such as prints or other merchandise.
• Use in content creation i.e. streaming or video production.

P R I C I N G - & - T O S - C H A N G E SThe artist retains the right to change either the pricing and/or the ToS at any point in time, for any reason.- If these changes occur after a commission has been paid (including partial payment), the client is held to the previously agreed price and terms.- If these changes occur after a price has been agreed upon in writing but has not been paid, the client is held to the previously agreed price but the new terms.
